Justice, justice?
America was founded on the basis of the humanitarian ideals of the ancient Hebraic law as expressed in the Hebrew Bible and rabbinical rulings. The Bible states in Leviticus 19:15 (my free translation): “You shall not pervert justice by having empathy for the poor or glorifying great people; instead, you shall judge your countrymen with justice.”
Elena Kagan’s ringing endorsement of constitutional interpretation demanding “special solicitude…for the disadvantaged” means she will not judge her fellow Americans with justice.
Another important verse is Deuteronomy 16:20: “You shall pursue justice, justice in order that you shall live and inherit the land that God your God gave you.” The word “justice” is repeated, to stress that there are two sides that the judges must consider. The reason why we need judges and justice is in order to live. Without justice, a society cannot survive. Since there are questions about Kagan’s judicial fairness, appointing her as a justice will put the survival of America in jeopardy.
